Cheque Bounce cases under section 138 of the Negotiable Instruments form around over thirty percent of the total criminal cases in our country. Issuance of cheques for making or securing payments has become the most trusted method in our country due to the fear of criminal liability. However, the huge pendency of such cases has undone some of the benefits of section 138 and has resulted in huge backlog of cases. With the growth in online payments, Payments and Settlement System Act, 2007 has also achieved prominence akin to section 138 of the Negotiable Instruments Act, 1881.
